Terms & Conditions of Membership, Packages & Class Attendance
By purchasing a membership, package, or by booking/attending a class you confirm you have read and understood the terms and conditions stated on the FitFor45 website and the Legit Fit Booking App.
Client/Member Terms & Conditions - FitFor45
Memberships
Memberships are 1 month or 3 month recurring payments. FitFor45 does not offer refunds on services or products for change of mind, user error, injury, change of address, or any other reason. Memberships cannot be frozen for anytime under 2 weeks. Members/Clients can apply for their membership to be frozen for a duration of 2-4 weeks (10 class packages are not included). If a Member/Client needs to freeze a membership for longer than 4 weeks, they will need a doctor/physio letter to state that they cannot exercise due to injury or illness. FitFor45 has the right to deny this request. If a membership has been frozen for a period, it is the responsibility of the client/member to know when the date that the membership reactivates. There will be no notification from FitFor45. Members/clients can freeze a membership for a maximum three times per year. You agree that this contract is not assignable or transferable to any other person, persons or organisation. FitFor45 is not liable to refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason. All purchases are final. You understand FitFor45 has the right and the authority to terminate memberships & packages at any time, without a refund, if you fail to conduct yourself in an appropriate manner. Memberships are recurring, if a Client/Member wishes to cancel their membership notification must come to info@fitfor45.com at least three (3) days before the next renewal/billing date. Our timetable, capacity & coaching staff schedule is forecasted from our membership numbers. If you wish to change your membership and avoid the joining fee again on another membership, please email info@fitfor45.com at least three (3) days before the next renewal/billing date.
Booking Classes & Changing Classes
You must pre-book your class online through our booking platform LegitFit. You can book up to 30 minutes prior to the session commencement. Payments are made through our online booking system.
If you cancel a class within sufficient time (at least 3 hours before class) you can book another slot if another class is available. This cannot be guaranteed, depending on the slots available. If the client/member books a single class, paying €12 and wants to change classes they must cancel their booked class at least three hours before the booked class & then book another class paying €12 (See below for information on receiving back the credit for the first class booked).
Class Cancellations
Class cancellations must be made via the online booking system, Legit Fit.Clients/members have up to 3 hours prior to the booked session to cancel without penalty. Cancellations will be accepted via LegitFit only not via text, email, or other messaging services. If you cancel a class outside of the booking window you will lose this class on your package or membership. If you do not attend a booked class you will also lose this class on your package or membership. This applies to all of our packages and membership. If you have paid €12 for a single class and you cancel within sufficient time (at least 3 hours before class), you will be notified by the FitFor45 team on a monthly basis that you have a class credit. If you do receive a refund on any of our products, there will be a Stripe transaction processing fee.
Client/Member Responsibility
It is your responsibility to advise us of any changes to your health status that may alter your ability to perform a prescribed exercise program. You are advised to not attend a session if suffering from any infections or contagious illness, disease, or other ailments. We reserve the right to cancel or discontinue a class if we feel that starting or continuing the class may be detrimental to your health, safety, comfort, or physical condition. You must complete a health screening form online prior to arrival at your first class and you must notify us of any pre-existing medical condition or injury. We are not trained, medical professionals or physiotherapists. Before you undertake any vigorous exercise program, you should consult your doctor. If you believe there is any risk to your health from doing any of our exercises, you must notify us immediately. You understand that during any class provided by us, there is a possibility you may suffer an injury or illness as a result of participation in the agreed physical activity program. In attending classes at FitFor45, you agree that neither you, your heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against FitFor45 or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
Memberships are recurring, if a Client/Member wishes to cancel their membership notification must come to info@fitfor45.com at least three (3) days before the next renewal/billing date. It is the responsibility of the client/member to ensure that they are in the Whatsapp Group to be notified in there are any changes/cancellations to our schedule.
You agree to turn up to sessions five (5) minutes before scheduled commencing times to receive a debriefing, take part in the full warm-up, and to ensure the class time schedule is followed. You understand that any delays to the start of a scheduled session will not be a cause of extended services beyond the remainder of the scheduled time. You will not expect or request your trainer to run overtime. You agree to dress in appropriate workout clothing during all sessions. Ensure you bring a water bottle. Make sure you have eaten within two (2) hours of your training sessions and are well hydrated. By not following this information it may cause negative health effects. Equally, eating a large or heavy meal just prior to your session should also be avoided.
Terms & Conditions of Membership, Packages & Class Attendance
As a FitFor45 Member/Client you will be instructed by a qualified Fitness Instructor. Each class runs for the duration of 45 minutes to 1 hour, sessions include a warm-up, main phase and cool down unless otherwise arranged by your trainer. Every possible effort is made to deliver classes and services on time as advertised. However, the schedule is subject to change or cancellation without notice. Session times/locations may be modified (or) cancelled on public holidays or depending on the weather forecast. FitFor45 reserves the right to refuse participation to any member or client. FitFor45 is not responsible for the safekeeping of your belongings.
FitFor45 uses a range of mediums to communicate with members including, but not restricted to, direct mail, email, SMS, push notifications, and telephone. We also use cookies to help advertise our products and services. You will receive communications from FitFor45 from time to time updating you on items relating to programs, our memberships & packages or promotions. FitFor45 acknowledges and respects the privacy of its members. We will securely and confidentially maintain all personal, medical, and training information and individual training logs pertaining to you and will not disclose your information to any third party in any circumstance except where required by law. By attending a session at FitFor45 you agree that a photograph or a video of you may be taken. This may be used on our website or in our marketing material, including online and offline material.
COVID-19 Conditions
FitFor45 takes no responsibility for any infectious diseases or viruses contracted at any class, in any location where classes may take place. This includes COVID-19. FitFor45 sublet premises for classes and these premises take no responsibility for any infectious virus' and diseases contracted at any class. You are advised not to attend a session if you are suffering from any infections or contagious illness, disease, or other ailment or whilst suffering from any physical ailment such as open cuts or sores or minor infections where there is a risk. Do not attend class if you are displaying symptoms of COVID-19.
